These terms cover your use of this website. Work we do for clients is covered by a separate written agreement and quote.
Your agreement to these terms
By using this site, or by submitting any form on it (the quote form, the request-a-call form, a job application or a job description request), you confirm that you have read these terms and our privacy policy, that you accept them, and that you are at least 18 and able to enter into this agreement, or are acting for a business that can. A notice with links to both documents appears next to each submit button, and pressing the button is your acceptance. If you do not accept, do not use the site or submit a form. You can contact us by email instead, and the same terms apply to any information you send us that way.
These terms may be updated from time to time. The date at the top shows the latest version, and continued use of the site after an update means you accept it. For client work, the written quote and agreement you sign are what apply, and where they differ from these terms, they come first.
Using the site
You may use this site to learn about our services and contact us. Don't misuse it, for example by trying to break its security or sending spam through our forms.
Content
The content, design and logo on this site belong to Pine Peak Creatives unless stated otherwise. Platform names and logos belong to their owners. All trademarks are the property of their respective owners.

Articles and guides on this site are general information, not legal, tax or financial advice.
Quotes
Nothing on this site is an offer. Prices and scope are only binding once set out in a written quote and agreement.

No warranties
This site and everything on it is provided "as is" and "as available". To the fullest extent the law allows, we give no warranties of any kind, express or implied, including that the site will be uninterrupted, error-free or secure, that its content is accurate, complete or current, or that it suits your particular purpose. Examples, timelines, figures and descriptions of results on this site show what we aim for. They are not promises about what any project will achieve for you.
Limit of liability
To the fullest extent the law allows, Pine Peak Creatives and its owners, staff, contractors and providers are not liable for any loss or damage of any kind that arises from your use of, or inability to use, this site or its content. That covers direct, indirect, incidental, special, consequential and punitive damages, and lost profits, revenue, data, goodwill or business opportunity, whatever the legal theory and even if we were told the loss could happen. If a court decides we are liable despite these terms, our total liability for all claims about the site is limited to US$100.
Things outside our control
We aren't responsible for failures or delays caused by events we can't reasonably control, such as outages at hosting, internet, email or other providers, cyberattacks, power or network failures, or acts of government. We also aren't responsible for third-party websites, tools or services linked from this site, or for anything you send us by email or form before an agreement is signed.
What these limits do not cover
Some places don't allow certain limits, and the law can't be waived by a website. Nothing in these terms limits liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, for harm caused intentionally or by gross negligence, or for any right you have that cannot lawfully be excluded, including consumer and data protection rights. Where a limit is not allowed, it applies only as far as the law permits and the rest of these terms still stands. Liability for client work is set by the written agreement for that work.
Indemnity
If your misuse of the site or breach of these terms causes a third-party claim or a loss to us, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
Governing law
These terms are governed by the laws that apply to the Pine Peak Creatives business, unless the law where you live says otherwise. If you have a question about this, email us.
